Summary: By using Embroidery Trend, you agree to these terms. We sell digital embroidery design files for personal and small business use. All sales are final for digital products, but we offer a 30-day guarantee if files are incompatible or corrupt.
1. Agreement to Terms
By accessing or using the Embroidery Trend website (embroiderytrend.com), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our website or purchase our products. We reserve the right to modify these terms at any time, and your continued use of the website constitutes acceptance of any changes.
2. Products & Services
Embroidery Trend sells digital machine embroidery design files. Our products are downloadable digital files and are not physical goods. Each design is provided in multiple embroidery file formats including, but not limited to, PES, DST, EXP, JEF, XXX, HUS, VP3, and SEW.
⚠️ Important: Our designs are digitized embroidery files, not finished embroidered products. You will need an embroidery machine and appropriate supplies to use these files. Please verify that your machine supports the file formats included before purchasing.
3. License & Permitted Use
When you purchase an embroidery design from Embroidery Trend, you receive a non-exclusive, non-transferable license to use the design file. Here is what you can and cannot do with our designs:

- Use designs for personal embroidery projects
- Use designs to create finished embroidered products for sale (small business use)
- Stitch designs on items you sell at craft fairs, Etsy, or your own shop
- Resize designs within your embroidery software for different hoop sizes
- Store backup copies on your personal devices
❌ You CANNOT
- Resell, share, or distribute the digital design files themselves
- Upload designs to free or paid download websites
- Claim the digital designs as your own creation
- Use designs for mass commercial production (over 500 items per design)
- Transfer your license to another person or business
If you need a license for mass commercial production (over 500 items), please contact us for a commercial licensing agreement.
4. Purchases & Payment
All prices are listed in US Dollars (USD). We accept payments through PayPal and major credit/debit cards via Stripe. By completing a purchase, you agree that you have provided accurate billing information and that you are authorized to use the payment method provided.
Upon successful payment, you will receive immediate access to download your purchased embroidery design files. A confirmation email with download links will also be sent to the email address associated with your order.
5. Refund & Returns Policy
Full refund if files are corrupt, missing, or incompatible

Refunds processed within 5-7 business days
Due to the digital nature of our products, we generally do not offer refunds for change of mind or incorrect purchases. However, we will provide a full refund within 30 days if the design files are corrupt or cannot be opened, the files are missing from your download, or the design is significantly different from what was advertised on our website.

6. Intellectual Property
All embroidery designs, website content, graphics, logos, and other materials on Embroidery Trend are protected by copyright and intellectual property laws. The Embroidery Trend name, logo, and branding are our trademarks.
Some of our designs may feature elements inspired by popular culture, sports teams, or well-known characters. These designs are created as fan art or parody and are intended for personal use. We do not claim ownership of any third-party trademarks or copyrights referenced in our product descriptions.
7. User Accounts
To make a purchase, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary.
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or attempt to redistribute our digital products.
8. Website Availability
We strive to keep our website available 24/7, but we do not guarantee uninterrupted access. We may temporarily suspend the website for maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by temporary unavailability of the website.
9. Disclaimer of Warranties
Our embroidery design files are provided “as is.” While we test all designs for quality and compatibility with major embroidery machines, we cannot guarantee that every design will work perfectly with every machine and software combination. Stitch quality may vary depending on your machine settings, thread quality, fabric type, and stabilizer used.
We recommend always stitching a test sample before embroidering on your final project, especially with new designs or unfamiliar fabrics.
10. Limitation of Liability
To the maximum extent permitted by law, Embroidery Trend shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.
11. Governing Law
These Terms of Use shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of our website shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes will be submitted to binding arbitration.
